PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS OUT THE TERMS UNDER WHICH THE HAT CLUB LTD OFFERS YOU USE OF ITS HATS. BY HIRING A HAT FROM THE HAT CLUB YOU AGREE THAT YOU HAVE READ AND ACCEPT THESE TERMS AND CONDITIONS AND THAT THEY SHALL APPLY TO YOUR USE.

This Agreement is made between you and The Hat Club Ltd (registered number 08426627) whose registered office is Studio 5, Hurlingham Studios, Ranelagh Gardens, England, SW63PA.

The following terms and conditions apply:

1. HIRE TERMS (CONDITIONS OF HIRE)

1.1 The hat(s) remain the property of The Hat Club Ltd at all times.
1.2 The full hire fee of the hat is payable on reservation.
1.3 Hats are hired per occasion. Hire periods usually last three days or four over a weekend (Friday to Monday).
1.4 The Hat Club Ltd reserves the right to make substitutes without prior warning for any article that may be unavailable.
1.5 The Hat Club Ltd will not be liable for any delay or failure to deliver due to circumstances which are out of its control; or for any damage or injury caused by the misuse of the Company’s property.
1.6 The liabilities of the hirer commence at the time the hired hat(s) are collected from our premises or other location agreed by The Hat Club,  and continue until they are returned to the premises or a representative of The Hat Club Ltd.
1.7 Cancellation policy: The full hire fee will be refunded for cancellations made 14 days before the hire date. The full hire fee will be retained for cancellations made less than 14 days prior to the hire date.
1.8 On collection, a deposit is required for all items, equivalent to the retail value of the hat as advised by The Hat Club Ltd.

 

2. BILLING

2.1 When you hire a hat you will be required to provide The Hat Club with accurate, complete and current credit or debit card information for a valid credit or debit card that you are authorized to use.
2.2 By signing up for the Service, you authorize The Hat Club to bill your credit or debit card the applicable fees, per-item or borrowing fees, courier charges, any and all applicable taxes, and any other charges you may incur in connection with your use of the Service. The applicable fees will be charged to your credit or debit card on the date your hire is made.
2.3 If your hat is not returned on the due return date agreed when the purchase was made, The Hat Club will charge your credit card for each overdue day, at the rate set for that hat as stated by The Hat Club, until a return date has been agreed by the customer and The Hat Club are notified by the courier company.
2.4 The Hat Club may modify the price, content, or nature of the Service at any time. We may provide notice of any such changes by email, or by publishing them on the Site.
2.5 Damage to property: If damage exceeds normal wear and tear, as determined by The Hat Club in its sole discretion, you agree that The Hat Club may charge/invoice you for the full cost of replacing the hat as well as charge you the full amount of any lost earnings or incurred costs resulting from the damage. The product replacement fee will vary depending on the specifics of each hat and its amount is to the full discretion of The Hat Club.
2.6 Customers are required to check their order carefully and ensure it’s in the correct condition before leaving The Hat Club Ltd premises or staff member with the goods.


3. HAT CARE AND HIRE RESPONSIBILITY

3.1 Weather is the enemy of the hat and although we appreciate it is beyond control, please care for the hired hat in the rain as you would if it was your own. Keep it under an umbrella at all times when it is raining and be aware of certain fabrics and features of hats being more susceptible to weather damage in bad conditions. The Hat Club reserves the right to retain the full deposit if the item is returned marked or damaged in any way. This includes but is not limited to holes, dents, stains and rain marks. Credit or debit card details will be taken as a form of deposit and will only be deducted accordingly after discussion with the hirer and The Hat Club Ltd.
3.2 Under no circumstances are customers to attempt to clean any hats themselves by any means. If done so, The Hat Club reserves the right to invoice for part or full replacement value of the items and charge you the full amount of any potential lost earnings or incurred costs regardless of whether any damage has been caused.
3.3 If the hat is damaged beyond repair, lost or stolen then the full purchase price would be paid by the hirer. The replacement cost will be determined by The Hat Club.
3.4 Should a previous hirer not return a hat you have booked to hire or it is damaged, The Hat Club Ltd will endeavour to find a good and suitable replacement. A direct replica style and colour cannot be guaranteed. Liability is limited to the return of the hire charge if a suitable alternative is not available.
3.5 All original hat boxes must be returned with the hat hired. Customer will be liable to a £10 charge to cover the cost of replacing any hat boxes not returned.

 

PRIVACY POLICY

1.1 This privacy policy sets out how The Hat Club uses and protects any information that you give The Hat Club when you use this website or hire a hat from The Hat Club. The Hat Club is committed to ensuring that your privacy is protected. You can be assured that it will only be used in accordance with this privacy statement.
1.2 Saved card details will never be shared with third parties and will only be used to process your order, using our payment partner's systems. Additionally we may also obtain information as a result of authentication or identity checks. Sometimes we may ask for your telephone number. This number may be given to our courier for delivery services. These details allow us to process your order and to let you know the status of your order.
1.3 The Hat Club may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from May 1, 2013.
If an order is placed with us, we need to hold personal information including your name, email address, phone numbers, home address, shipping and credit/debit card billing address(es) so that we can process and fulfill your order.

What we collect

We may collect the following information when you take out our hat hire service:

  • Name
  • Contact information including email address and mobile telephone number.
  • What we do with the information we gather

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • We may use the information to improve our products and services.
  • We may periodically send promotional emails about new hats, products and services, special offers or other information which we think you may find interesting using the email address which you have provided.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, or mail.


4. RACEDAY CONDITIONS OF HAT HIRE (INVESTEC DERBY AND ROYAL ASCOT)

4.1 The hat(s) remain the property of The Hat Club Ltd at all times.
4.2 The full hire fee of the hat is payable on reservation.
4.3 Hats are hired per occasion. Hire periods usually last three days or four over a weekend (Friday to Monday).
4.4 During Royal Ascot and Epsom’s Derby Festival the hire period that hats are hired is for one specific race day only, unless agreed otherwise (the hire period will be for around 12 hours only depending on the time of collection). This hire period can be flexible depending on availability as agreed between the hirer and The Hat Club Ltd.
4.5 Any hat(s) hired during Royal Ascot or Epsom’s Derby Festival must be returned by 9.30pm of that specific race day.
4.6 Any hat(s) not returned by 9.30pm of that specific raceday will be charged another day’s hire for each day thereafter that the hat is not returned.
4.7 The Hat Club Ltd reserves the right to make substitutes without prior warning for any article that may be unavailable.
4.8 The Hat Club Ltd will not be liable for any delay or failure to deliver due to circumstances which are out of its control; or for any damage or injury caused by the misuse of the Company’s property.
